Ejecución en arbitraje internacional de las decisiones “vinculantes y definitivas” y “vinculantes pero no definitivas” del dispute board conforme a los modelos que integran la Rainbow Suite FIDIC

El presente estudio versa sobre la ejecución en arbitraje internacional de las decisiones “vinculantes y definitivas” y “vinculantes pero no definitivas” del dispute board en los supuestos de incumplimiento, de acuerdo con los cauces contractuales de impugnación y reclamación previstos en los modelos que integran la Rainbow Suite FIDIC de 1999 y de 2017, aclarando la distinción entre la eficacia vinculante y el carácter definitivo y no definitivo de la decisión. Con el fin de superar las dudas que aún existen en la materia, el autor propone, como fórmula óptima para obtener una rápida ejecución de la citada decisión, la bifurcación del procedimiento arbitral mediante la petición de un laudo parcial, solicitando la ejecución de la decisión vinculante pero no definitiva, así como la revisión de la controversia subyacente mediante un laudo final.
