International arbitration enforcement of ‘binding and final’ and ‘binding but not final’ decisions of the dispute board under the Rainbow Suite FIDIC models

The present study addresses the international arbitration enforcement of “binding and
final” and “binding but not final” dispute board decisions, in accordance with the procedures provided for in the 1999 and 2017 editions of the Rainbow Suite FIDIC models, clarifying the distinction between the binding effectiveness and the final and non-final nature of the decision. In order to overcome the doubts that still exist in this field regarding the enforcement of the dispute board decisions, the author proposes, as an optimal formula for obtaining a rapid enforcement of the aforementioned decision, the bifurcation of the arbitration proceedings by means of the petition for a partial award, requesting the enforcement of the binding but not final decision as well as the review of the underlying dispute by means of a final award.
